Brickbrag sponsor terms
1. Who we are
Brickbrag is run by DIE ANTWORT · Büro für Informationstechnik GmbH, Obere Weißgerberstraße 4, 1030 Vienna, Austria. Company register FN 315384a, Commercial Court of Vienna (HG Wien). VAT ID ATU64397502. Business: IT services. Member of the Vienna Chamber of Commerce (Wirtschaftskammer Wien). Supervisory authority under the Austrian E-Commerce Act: Magistratisches Bezirksamt des III. Bezirkes. Contact: Moritz Kobrna, team@die-antwort.eu, +43 1 997 16 20-0 (“we”, “us”).
2. What these terms cover
These terms apply when a company or other business (“sponsor”, “you”) asks for and buys a sponsor space in the Brickbrag city: a flag on a street lamp, a bus stop poster, a kiosk, a sponsor house or the main sponsor tower (“space”). Sponsoring is offered to businesses only (entrepreneurs in the sense of the Austrian Business Code, UGB), not to consumers. By sending a request you confirm that you act for a business and that you may bind it.
3. How it works
- Request. In the sponsor menu you choose a space and enter your website, title, tagline (where the space shows one), a background color and your email address. Sending it is a non-binding request – you pay nothing and enter no card.
- Review. We check every request. We may refuse a request without giving reasons (see 5).
- Offer and contract. If we accept, we email you a payment link. That email is our offer; the contract is made when you pay. If several requests ask for the same space, we decide which one we accept.
- Going live. After the payment has arrived, we put your sticker on the space – usually within two working days – and tell you by email. It shows there for 30 days (see 7).
4. Prices, VAT and payment
The prices shown in the game are one-time prices in euros for 30 days, net (without VAT). We send you a payment link through our payment provider (Stripe); there you enter your company details, billing address and – if you have one – your VAT ID, and the checkout adds VAT as the law requires for services to businesses (for example Austrian VAT for a business in Austria, the reverse-charge procedure for a business in another EU country with a valid VAT ID). You receive an invoice. There is no subscription and nothing renews.
5. Your content
- Your sticker shows only what you give us: your title, your tagline, your background color and the icon we take from the website you name. You can change nothing else, and nobody else can change your sticker.
- You warrant that you own or are allowed to use everything you give us – your name, marks, icon and texts – and that showing it in Brickbrag infringes no rights of others (trademarks, copyright, name rights, competition law). You hold us harmless against claims by third parties that arise because this was not so, including reasonable legal costs.
- Brickbrag is played by children and teenagers. Content and the website it links to must be suitable for people under 16. Not allowed: anything illegal, sexual content, violence, hate or discrimination, weapons, drugs, alcohol, tobacco, e-cigarettes and vaping, medicines, gambling and betting, crypto assets and crypto trading, financial or investment advice and trading platforms, political or religious campaigning and political advertising, misleading claims, and anything that harms our reputation.
- Your texts must not call on children to buy something or to get their parents to buy it for them – no “buy …”, “get yours …” aimed at players. Every sponsored space is marked as sponsored (“Sponsored”, in German “Anzeige”).
- You grant us, for as long as the sponsorship runs, the non-exclusive, royalty-free right to show your content in Brickbrag, in its screenshots and videos, and on our own pages that show the city.
- On brickbrag.com for good. Every sponsor is also listed on brickbrag.com with its name, icon and a link to its website – not only for the 30 days but for as long as the site exists. For that you grant us the same right without a time limit. You can ask us at any time to take you off the list.
6. Removal
We may take a sponsor down at once if its content or the linked website breaks section 5, if a third party credibly claims an infringement, or if a public authority asks us to. There is no refund in that case. You may ask us at any time to take your sponsorship down; that does not entitle you to a refund either.
7. 30 days, a one-time purchase
A sponsorship shows on its space for 30 days from the day it goes live. You pay once; there is no subscription and nothing renews – after 30 days it ends by itself and the space is free again. If you want to keep it, you can buy another 30 days; we let you know a few days before it ends. We promise no number of players, views or visits to your website, and there is no refund. We may change the city: we may move your sponsorship to an equivalent space, change the look of buildings and stickers, or end the game.
8. Visits to your website
Players near your space can press E (or tap) to open your website in a new tab. Your website is your responsibility. We do not track players on your website and do not report clicks.
9. Liability
We are liable without limit for intent and gross negligence and for personal injury. For slight negligence we are liable only for breaches of essential contractual duties and only up to the price you paid; liability for lost profit, indirect and consequential damage is excluded as far as the law allows. The game is provided as it is; we do not guarantee that it is always available.
10. Privacy notice for sponsors (GDPR)
- Controller: DIE ANTWORT · Büro für Informationstechnik GmbH (see 1), team@die-antwort.eu.
- What we process: the data in your request (website, title, tagline, color, email address), the icon taken from your website, your Brickbrag player name, the time of the request and that you accepted these terms; for paid sponsorships also the billing details you enter in the Stripe checkout (company, address, VAT ID) and the payment status.
- Why and on what basis: to review your request, contact you, make and fulfil the contract and invoice you (Art. 6(1)(b) GDPR); to keep accounting records (Art. 6(1)(c) GDPR with § 132 BAO and § 212 UGB); to protect the game and its players from unsuitable content (Art. 6(1)(f) GDPR, our legitimate interest).
- What is public: once your sponsorship is live, your title, tagline, icon, color and website address are shown to everyone in the game; your name, icon and website address are also listed on brickbrag.com, also after the 30 days (see 5). Your email address and player name are never shown.
- Who else gets data: our hosting provider (servers in the EU) as our processor; Stripe Payments Europe Ltd., Ireland, for the payment (under its own privacy policy); our email provider to send you messages. We do not sell data and use none for advertising.
- How long: a request we refuse or you withdraw is deleted after six months. For contracts we keep the data for as long as the sponsorship runs and then as long as tax and company law require (in Austria generally seven years).
- Your rights: access, rectification, erasure, restriction of processing, data portability and objection (Art. 15–21 GDPR) – write to team@die-antwort.eu. You may complain to the Austrian Data Protection Authority (Datenschutzbehörde, Barichgasse 40–42, 1030 Vienna, dsb.gv.at).
- There is no automated decision-making; every request is reviewed by a person.
11. Final provisions
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The courts competent for Vienna, Inner City, have exclusive jurisdiction. We may change these terms for future requests; a sponsorship already paid keeps the terms it was bought under. Should a provision be invalid, the rest remains in force. Agreements that differ from these terms need to be made in writing (email is enough).
